1. Agreement to these terms
By creating a trial, signing an order form, accessing a workspace, or using Aqari, you agree to these Terms of Service and any order form, subscription confirmation, or written agreement that references them.
If you use Aqari on behalf of a company, you confirm that you are authorized to bind that company to these terms.
2. Accounts, users, and responsibility
You are responsible for the accuracy of information submitted during trial signup, onboarding, and workspace setup. You are also responsible for all activity under your company workspace and user accounts.
- Keep login credentials confidential and use strong passwords.
- Give users only the permissions needed for their roles.
- Notify us promptly if you suspect unauthorized access.
3. Trials, subscriptions, and payments
Aqari may provide a 14-day trial workspace. Trial access may be limited, suspended, or ended if the workspace is misused, contains inaccurate signup information, or creates security or operational risk.
Paid subscriptions, prices, modules, unit limits, user limits, billing cycles, taxes, renewal terms, and implementation services should be stated in an order form or subscription confirmation.
Unless agreed otherwise in writing, fees are non-refundable once a paid subscription period or implementation service has started.
4. Platform use and acceptable conduct
You may use Aqari only for lawful business purposes. You must not reverse engineer the platform, attempt to bypass security, misuse APIs, upload malicious content, send spam, or use Aqari to violate third-party rights.
Additional acceptable-use rules are available in the Acceptable Use Policy.
5. Customer data, privacy, and processing
Your company owns the business data it enters or uploads into Aqari. Aqari and its provider retain ownership of the software, platform, code, design, workflows, documentation, templates, and related intellectual property.
Personal data is handled according to the Privacy Policy and, where applicable, the Data Processing Agreement.
6. No legal, tax, or accounting advice
Aqari provides software tools, workflows, calculations, and reports. It does not replace professional legal, tax, accounting, audit, or regulatory advice. You are responsible for reviewing outputs before relying on them.
7. Warranties and liability limits
Aqari is provided on an as-is and as-available basis except where a written agreement states otherwise. We do not guarantee that the platform will be uninterrupted, error-free, or suitable for every business process.
To the maximum extent permitted by law, total liability for claims relating to Aqari is limited to the fees paid for the affected service during the period stated in the applicable order form or, if no order form exists, the previous three months.
8. Suspension, termination, and data export
We may suspend access for non-payment, security risk, unlawful use, or material breach. Either party may terminate according to the applicable order form or written agreement.
After termination, customer data may remain available for export for a limited period unless prohibited by law, security requirements, or unpaid obligations.
